PHILADELPHIA –– Benzene defendant U.S. Steel has argued that a Pennsylvania lawsuit belongs in New York, citing the plaintiffs’ residences, worksites, and medical care.
In the Oct. 30 motion to dismiss on forum grounds, U.S. Steel says that the Pennsylvania Court of Common Pleas for Philadelphia County should not hear the matter since the plaintiffs have “not identified any possible exposures to benzene or benzene-containing products other than the exposure alleged in upstate New York.”
