5th Circuit Issues Briefing Schedule in Appeal of Dismissed Benzene Action

NEW ORLEANS –– The U.S. Court of Appeals for the 5th Circuit has issued a briefing schedule in an appeal involving a lower court’s dismissal of benzene claims, allowing the plaintiffs until May 6 to submit their brief.

In the briefing notice issued March 26, the 5th Circuit noted that any reply briefs must be filed within 14 days of the plaintiffs’ submission.

On March 18, the Louisiana benzene plaintiffs notified the federal court of their intent to appeal the U.S. District Court for the Eastern District of Louisiana’s decision to exclude the testimony of Dr. Bhaskar Kura and award …
