Louisiana Federal Court Refuses to Reconsider Order Dismissing Benzene Case on Admissibility Grounds

NEW ORLEANS –– A Louisiana federal court has reaffirmed its decision that a benzene plaintiff had failed to provide admissible evidence to support claims that Craig Moore developed multiple myeloma as a result of exposure to benzene-containing paint products.

In the Feb. 19 decision, the U.S. District Court for the Eastern District of Louisiana denied the plaintiffs’ motion to reconsider the dismissal of their claims, opining that even if it hadn’t excluded the testimony of Dr. Bhaskar Kura, the plaintiffs had failed to support their claims under the Louisiana Products Liability Act.
