N.Y. Appellate Court Reverses Dismissal of Workers' Comp Benzene Claim

ALBANY, N.Y. -- A New York appellate court has reinstated a workers' compensation claim involving exposure to benzene, finding that the claims were not time-barred. Kasic, et al. v. Bethlehem Steel Corp., et al., No. 512068 (N.Y. Sup. Ct., App. Div., 3rd Jud. Dept.).

In the April 26 opinion, the Third Judicial Department, Appellate Division, of the New York Supreme Court found that the claimant did not have grounds for her claim until she received competent medical evidence linking her husband's leukemia to his benzene exposure.
