NEW ORLEANS - A Louisiana federal judge has granted defendants in a benzene exposure case summary judgment on a loss of consortium claim, ruling that because the plaintiff was diagnosed with cancer before he married, his spouse cannot recover on the claim. Moore v. BASF Corp., No. 11-1001 (E.D. La.).

On April 3, Judge Sarah S. Vance of the U.S. District Court for the Eastern District of Louisiana granted E.I. DuPont De Nemours and Co., Valspar Corp. and International Paint LLC summary judgment on the loss of consortium claim.
