CAMDEN, N.J. -- Two defendants named in a benzene complaint have removed the lawsuit to federal court, contending that federal enclave jurisdiction exists since the plaintiffs allege exposure at military bases. Cacoilo, et al. v. The Sherwin Williams Co., et al., No. 11-07039 (D. N.J.).
Safety-Kleen Systems Inc. and The Sherwin Williams Co. removed the complaint to the U.S. District Court for the District of New Jersey on Dec. 2.
According to the removal notice, the underlying lawsuit involved claims asserted on behalf of Nilton Cacoilo, who was a member of the U.S. Marine Corp. While in the service, Cacoilo …
