Radiator Specialty Backs Filing of Recent Answer, Says it Doesn't Prejudice Plaintiffs

NEW ORLEANS -- Radiator Specialty has backed its efforts to file a new answer to the complaint just months before trial, saying that the defenses asserted in the latest filing were previously raised and therefore do not prejudice the plaintiffs. Wagoner v. ExxonMobil, No. 09-07257 (E.D. La.).

In the Oct. 3 brief filed in the U.S. District Court for the Eastern District of Louisiana, the defendant opposes a motion to strike in which the plaintiffs contend Radiator Specialty's answer was "improperly filed and untimely."
