Benzene Plaintiffs Move to Remand, Say Bankruptcy Proceeding Has No Bearing on Case

CAMDEN, N.J. -- Benzene plaintiffs with a lawsuit pending in New Jersey federal court have moved to remand their case, saying that it did not arise in a bankruptcy case and instead is "merely related to a bankruptcy case." Taylor, et al. v. The Sherwin Williams Co., et al., No. 11-03413 (D. N.J.).

In a July 14 motion filed in the U.S. District Court for the District of New Jersey, the plaintiffs contend that remanding the case will have no negative impact on the administration of the bankruptcy estate.
