Nev. Court Issues Split Ruling in Gasoline Case, Says Record Not Fully Developed

LAS VEGAS -- A Nevada state court has denied several motions for summary judgment in a benzene case, finding that it could not dismiss some of the pending claims because the record is not fully developed. Lewis, et al. v. Rebel Oil Co., et al., No. A566869 (Nev. Dist. Ct., Clark Cty.).

In the March 9 notice of entry of order, the Nevada District Court for Clark County also denied challenges to expert testimony proffered in support of both general and specific causation, ruling that, "at this time," the experts were qualified as expert witnesses.
