Nev. High Court Affirms Decision Allowing Firefighter's Breast Cancer Claim to Continue

CARSON CITY, Nev. -- The Nevada Supreme Court has upheld a decision backing a former firefighter's workers' compensation claim, in which the plaintiff argued that her breast cancer was caused by exposure to benzene during the course of employment. City of Las Vegas v. Lawson, No. 53900 (Nev. Sup. Ct.).

In the Dec. 30 opinion, the high court opined that the defendant, the City of Las Vegas, had not presented sufficient evidence to rebut the presumption that the plaintiff's breast cancer arose out of and in the course of her employment.
