Court Grants Joint Motion to Dismiss Defendants from Benzene Case

BEAUMONT, Texas -- A Texas federal court has granted a joint motion for dismissal, ordering that all claims against defendants Radiator Specialty and Ingram Barge Co. be dismissed with prejudice. McClurg, et al. v. Ingram Barge Co., et al., No. 09-504 (E.D. Texas).

The Aug. 24 order entered in the U.S. District Court for the Eastern District of Texas less than one month after the parties had sought dismissal.

The underlying lawsuit was filed on behalf of Duard Wayne McClurg, who the plaintiffs claim was exposed to a variety of toxic chemicals, including benzene, while working as a seaman …
