Court Defers Judgment on Dismissal Motions, Will Resolve Jurisdictional Dispute First

CAMDEN, N.J. –– A federal court in New Jersey has denied several pending motions to dismiss without prejudice, stating that it will first address the plaintiffs’ pending motion to remand. Cacoilo, et al. v. The Sherwin-Williams Co., et al., No. 11-7039 (D. N.J.).
In the June 25 order, the U.S. District Court for the District of New Jersey said that in the event that the plaintiffs’ motion to remand is denied, “defendants may reinstate their respective motions by filing a letter application with the court.”
