1st Circuit Establishes Briefing Deadlines in Causation Appeal

BOSTON -- The plaintiffs appealing a decision that dismissed their benzene claims have until Feb. 22 to file their appellant brief with the U.S. Court of Appeals for the First Circuit, according to a briefing notice. Milward v. Acuity Specialty Products Group Inc., et al., No. 09-2270 (1st Cir.).

The briefing notice was entered Jan. 11 in the 1st Circuit, which is poised to weigh in on whether a federal court erred when opining that general causation in a benzene case was "at best a plausible hypothesis."
