NEW ORLEANS -- Defendants named in a myelodysplastic syndrome benzene lawsuit have removed the claims to federal court in Louisiana, contending that diversity of citizenship exists. Barrois, et al. v. Fireman's Fund Insurance Co., et al., No. 09-0380 (E.D. La.).
Since the January filing of the notice of removal in the U.S. District Court for the Eastern District of Louisiana, no motion to remand was filed on behalf of the plaintiffs, according to the federal court's online docket.
A scheduling order filed in March noted that trial in the proceedings had been set for March 2010.
