Kentucky Court Proposes Amendment to $700,000 Class Settlement

LOUISVILLE, Ky. -- A federal court has approved the majority of a class settlement proposal, concluding that since the value of the property damage and personal injury chemical exposure claims is not obvious, the "modest" settlement amount is proper. Donaway, et al. v. Rhom and Haas Co., et al., No. 06-575 (W.D. Ky.).
In the July 1 opinion, the U.S. District Court for the Western District Court of Kentucky did find, however, that a section enforcing the settlement on non-parties to be "quite unfair."
