Texas Judge Denies Efforts to Challenge Admissibility in CLL Case

GALVESTON, Texas -- A Texas judge overseeing a benzene case in which the alleged injury is chronic lymphocytic leukemia (CLL) has denied defense efforts to dismiss the case on the ground that a general causal link was missing. Stewart, et al. v. Atlantic Richfield Co., et al., No. 09-CV-0120 (Texas 56th Jud. Dist. Ct., Galveston Cty.).

In a one-page order signed on May 26, the 56th Judicial District Court for Galveston County said that after considering the briefing, the defendants' motion for summary judgment was denied.
