Indiana Court Reverses Summary Judgment in Consolidated Asbestos Case

INDIANAPOLIS - In a consolidated asbestos case, an Indiana appeals court has reversed a trial court's decision to grant summary judgment to several defendants who claimed the plaintiffs were barred by the 10-year statute of repose from pursuing damages for their asbestos-related illnesses. Harris, et al. v. A.C.and S. Inc., et al., No. 45A03-0004-CV-144 (Ind. App. Ct., Third Dist.).

In an opinion issued Jan. 10, the Indiana Third District Court of Appeals entered its latest decision in a "line of cases" that reevaluate the role the statute of repose plays in disposing of asbestos claims. The court further ruled that …
