Appeals Court Upholds Testimony, $1.6 Million Asbestos Award




CLEVELAND, Ohio - An Ohio Appeals court has affirmed a $1.6 million verdict for a welder who developed mesothelioma after more than 40 years of alleged exposure to Pittsburgh Corning's Unibestos product. Cicchillo, et al. v. A Best Products Co., et al., No. 79288 (Ohio Appeals Ct., Eighth Dist.).

In an opinion released Jan. 10, the Eight District Court of Appeals rejected claims by the now-bankrupt asbestos defendant that the Cuyahoga County Court of Appeals abused its discretion when, among other things, it allowed the jury to receive instructions on both failure to warn and design defect theories of liability.
