Court Rejects Attempts to Use Frequency, Regularity and Proximity Standard

LOS ANGELES -- A California appellate court has affirmed a $12 million asbestos verdict, rejecting defense efforts to apply a frequency, regularity and proximity standard to the plaintiff's claims. Behshid v. Bondex International Inc., et al., No. B194789 (Calif. Ct. App., 2nd Dist., Div. 3).

In a July 22 opinion, the Second Appellate District Court also denied the defendant's claims that it was wrongfully precluded from using evidence and the verdict sheet to prove that other parties were responsible for the plaintiff's mesothelioma.
