Ohio Court Allows Intermediate Court to Rule on Asbestos Act Issues

COLUMBUS, Ohio -- The Ohio Supreme Court has issued two separate opinions that will allow an intermediate court to examine several issues relating to the state's Asbestos and Silica Act. Sinnott, et al. v. Aqua-Chem, Inc., et al., No. 2007-Ohio-5584; In re: Special Docket, No. 73958 (Ohio Sup. Ct.).

In the opinions, the high court found that the orders dealing with prima facie requirements of the act and retroactivity constituted a provisional remedy and were therefore final and appealable.

Trial court orders in both cases were previously rejected by the Eighth District Court of Appeals in Ohio for their failure …
