AUSTIN, Texas - The Texas Supreme Court on Oct. 12 denied a petition by asbestos plaintiff Arturo Flores to reconsider its June 8 opinion vacating a $150,000 verdict against brake-pad manufacturer Borg-Warner Corp. Borg-Warner Corp. v. Flores, No. 05-0189 (Texas Sup. Ct.).
The high court's decision came after defendants in the case opposed the rehearing request, saying that the motion did not contain any new arguments.
On June 8, the court vacated a jury's finding that Borg-Warner acted negligently and with malice and was strictly liable for Flores' asbestosis.
