Court Retains Case, Says Defendant Bound by Government Specifications

HARTFORD, Conn. -- A federal judge has declined to grant a motion to remand, finding that one of the defendants named in the asbestos lawsuit had sufficiently proved that its asbestos-containing products were made in accordance with military specifications. Machnik, et al. v. Buffalo Pumps Inc., et al., No. 07-357 (D. Conn.).

The Sept. 17 decision out of the U.S. District Court for the District of Connecticut further opines that General Electric established that the military specifications precluded the defendant from providing warnings to the plaintiff.
