Court Enforces Settlement Between Plaintiffs and Thorpe Insulation

SAN FRANCISCO -- A California appellate court has upheld the enforcement of a settlement agreement entered into by 44 asbestos plaintiffs and Thorpe Insulation, ruling that the documentation of the settlement did not have to take a formal format. Harowtiz v. Thorpe Insulation Co., et al., No. A114179 (Calif. Ct. App., 1st Dist., Div. 3).

On Sept. 28, the California First Appellate District Court of Appeals further found that it could not address the defendant's contention that it did not consent to the settlement because letters cited in support of the argument were not included in the record on appeal.
