AUSTIN, Texas -- Plaintiffs involved in an expert testimony admissibility dispute have filed a brief in the Texas Supreme Court backing their original petition, charging that because Mobil was dissatisfied with the plaintiffs' statement of fact, the defendant offered its own, false, version. Bailey, et al. v. Mobil Oil Corp., et al., No. 06-0444 (Texas Sup. Ct.).

The plaintiffs claims in their Sept. 28 reply that this defense-proffered statement of fact misrepresents the facts of the case, specifically dealing with details relating to exposure history, medical history and testimony relating to smoking history.
