Court Denies Rehearing Request in Take-Home Exposure Dispute

HOUSTON - A Texas appellate court has denied a woman's motion for rehearing and affirmed its previous finding that Exxon Mobil Corp. didn't owe a duty to the plaintiff because the company was unaware of take-home exposure dangers during the time of the alleged asbestos exposure. Exxon Mobil Corp. v. Altimore, No. 14-04-01133-CV (Texas 14th Ct. App.).

On Dec. 7, the Texas 14th Court of Appeals withdrew its Aug. 1 opinion and issued a substitute opinion with the same order reversing the judgment of the trial court and entering a take-nothing judgment for Louise Altimore on her claims against Exxon.
