MIAMI - A defendant appealing a trial court order that found the retroactive application of Florida's asbestos legislation unconstitutional has submitted as supplemental authority a recent decision in which an Ohio appellate court upheld the constitutionality of Ohio's asbestos legislation challenged on similar factual and legal grounds. DaimlerChrysler Corp. v. Hurst, et al., No. 3D06-2593 (Fla. Ct. App., 3rd Dist.).
