Summary Judgment Awarded on Admissibility Grounds in Lung Cancer Case

HOUSTON -- The judge overseeing the Texas asbestos MDL has awarded summary judgment to Garlock Sealing Technologies after sustaining the defendant's objections to medical causation in a lung cancer lawsuit. Manzie, et al. v. A.W. Chesterton, et al., No. 2004-55604 (Texas 11th Dist. Ct., Harris Cty.).

In the Nov. 20 order, Judge Mark Davidson of the Harris County District Court sustained Garlock's objections to Eva Manzie's causation evidence under Havner admissibility standards. As such, Judge Davidson awarded summary judgment to the defendant on all causes of action asserted by Manzie.
