Court Reverses Judgment for Plaintiffs in Meso Case, Orders New Trial

EL PASO, Texas - An appellate court has reversed judgment for the family of a Texas pipe fitter who died from mesothelioma and remanded the case for a new trial, stating that the trial court erred by denying defendant Garlock Inc.'s motion to transfer venue prior to trial. Gilcrease, et al. v. Garlock Inc., No. 08-04-367-CV (Texas Ct. App., 8th Dist.).

In a Dec. 21 opinion, the Texas 8th District Court of Appeals remanded the wrongful death suit to the El Paso County District Court with instructions to transfer the case to Bexar County District Court for a new trial.
