Jury Deadlocks in Boiler Exposure Case




WILMINGTON, Del. -- A Delaware jury has deadlocked in trying to determine whether asbestos-containing Weil-McLain boilers caused a former mechanic's mesothelioma, sources told HarrisMartin. Stewart v. Weil-McLain, No. 04C-10-013 (Del. Super. Ct., New Castle Cty.).

On Nov. 20, the Delaware Superior Court for New Castle County jury was declared hung after a two-week trial before Judge Mary M. Johnston.

Sources indicated that in post-trial meetings, the jurors said they were deadlocked 9-3 in favor of Weil-McLain. Proximate cause was named the reason for the deadlock, sources added.
