AUSTIN, Texas -- A Court of Appeals has affirmed a summary judgment award to an asbestos defendant, finding that the plaintiff failed to identify the defendant's product as an asbestos-containing one to which he was exposed. Ryan, et al. v. KCG, et al., No. 03-04-00150-CV (Texas Ct. App., 3rd Dist.).

In an Aug. 31 decision, the Texas Court of Appeals for the 3rd District affirmed summary judgment to KCG Inc., finding that there was insufficient evidence that the defendant supplied asbestos-containing products at the time during which the plaintiff alleges exposure occurred.
