Court Grants Defendants Leave to Appeal Port Authority Duty of Care Decision

NEW YORK -- A New York appellate court has granted a defense motion seeking leave to appeal a decision in which the court reversed the dismissal of the Port Authority from an asbestos lawsuit, opining the defendant did owe a duty of care to a woman alleging asbestos exposure by way of her husband's clothing. Holdampf, et al. v. ACandS, et al., No. M-5842 (N.Y. Sup. Ct., App. Div., 1st Dept.).

On Feb. 3, the First Department of the Appellate Division of the New York Supreme Court granted leave to appeal the decision to the state's highest court.
