EAST ST. LOUIS, Ill. -- Century Surety Company has filed a declaratory action against United Thermal Industries, claiming that it has no duty to defend or indemnify a former insured because the underlying lawsuit alleges exposure outside the coverage dates. Century Surety Company v. United Thermal Industries, et al., No. 04-656-DRH (S.D. Ill.).

In a complaint filed Sept. 14 in the U.S. District Court for the Southern District of Illinois, the insurance company further alleges that the policy issued to the defendant specifically did not cover asbestos claims.
