Judge Refuses to Overturn Arbitrators' Non-Products Coverage Ruling in ACandS Case

PHILADELPHIA - A federal judge has rejected a bid by ACandS Inc. to overturn a recent arbitration award that allowed Travelers Casualty and Surety Company to void its coverage of so-called non-products asbestos claims filed against the bankrupt asbestos defendant. ACandS, Inc. v. Travelers Casualty & Surety Co., No. 00-4633 (E.D. Pa.).

In a decision issued Sept. 15, Judge Petrese B. Tucker of the U.S. District Court for the Eastern District of Pennsylvania held that the arbitrators' decision to adjust Travelers' percentage of allocation for ACandS's non-products claim from 45 percent to zero was not irrational, as ACandS had alleged.
