Court Grants Motion to Non Suit Plaintiff in Middle of Jury Selection




PHILADELPHIA -- A Pennsylvania Court of Common Pleas granted a motion to non suit an asbestos lawsuit just a day after jury selection had begun, sources have told HarrisMartin. Kelly, et al. v. Owens Corning Glass Co., et al., No. 001101375 (Pa. Ct. Comm. Pls., Philadelphia Cty.).

Judge Matthew D. Carrafiello of the Philadelphia County Court of Common Pleas granted a motion to non suit the asbestos complaint on Feb. 2.

Plaintiff Charles Kelly alleged in the lawsuit that exposure to asbestos caused asbestos-related fibrosis. Kelly died at the age of 64 while waiting for a lung transplant, sources said.
