SALEM, Ore. - An Oregon Worker's Compensation Board has remanded a workers' compensation case filed by a man whose claim of lung-related injury was precluded by dismissal of a previous claim filed for a similar occupational injury. In a Nov. 5 decision, the board vacated the administrative law judge's decision to deny the claim based on issue preclusion, finding that the case had been insufficiently developed.
