N.Y. Court Rejects Efforts by Crane Co. to Obtain Summary Judgment; Limits Economic Testimony

NEW YORK –– A New York federal court has denied Crane Co.’s effort to obtain summary judgment in an asbestos exposure suit, concluding there was a genuine issue of material fact as to whether Grimes was exposed to asbestos from a Crane Co. valve based on the work done by others.

In the Nov. 30 opinion, the U.S. District Court for the Southern District of New York did limit the testimony of the plaintiff’s economic expert, finding that some of the figures relied upon the expert were not based on any “reliable, factually grounded assumptions specific to the [decedent].”
