Covil Corp. Signals Intent to Challenge $32.7 Million Asbestos Verdict in U.S. Supreme Court

RICHMOND, Va. –– Covil Corp. has moved the 4th Circuit U.S. Court of Appeals for an order staying issuance of mandate, indicating its intent to file a petition for writ of certiorari with the U.S. Supreme Court.

In the Oct. 9 motion, the defendant cited “reasonable” probability that the nation’s highest court would grant certiorari since the 4th Circuit’s decision in the asbestos-related manner conflicts with those of the 1st, 2nd, 5th, and 6th Circuits.

“All of these cases approved of verdict comparison as a matter of federal procedure in direct contrast with the Court’s decision here,” the motion said. …
