N.Y. Court Denies Summary Judgment in 2 Separate Asbestos Cases

NEW YORK –– A New York court has denied summary judgment motions filed by two defendants in two separate asbestos actions, finding in one that the testimony gives rise to a credibility determination and it is not the court’s role to resolve conflicting testimony.

In separate March 1 orders, the New York Supreme Court for New York County concluded in part that the “conflicting testimony above raises credibility issues which are a basis to deny summary judgment.”

In the first complaint, the plaintiffs asserted that George Maridakis came into contact with asbestos fibers while working as a contractor.
