N.Y. Court Denies American Biltrite’s Motion for Summary Judgment in Asbestos Colon Cancer Case

NEW YORK –– American Biltrite’s efforts to obtain summary judgment in a colon cancer asbestos case were rejected by a New York court, which opined that the conflicting evidence raises questions of fact to be determined by a jury.

In a Feb. 25 order, the New York Supreme Court for New York County denied the motion that levied both general and specific causation challenges against the plaintiffs’ claims.
