Armstrong Pumps’ Motion for Summary Judgment Denied in Asbestos Case

NEW YORK –– A New York court has denied Armstrong Pumps Co.’s motion for summary judgment in an asbestos case, concluding that the plaintiffs had raised triable issues of fact as to whether the defendant’s liability may be reasonably inferred from the decedent’s work around the product.

In the Jan. 11 order, the New York Supreme Court for New York County explained that the decedent’s failure to provide specific identification of Aurora pumps “does not mean that he was not exposed to the Aurora pumps as part of his work elsewhere on the ship.”
