Del. Federal Court Won’t Reconsider Order Granting Summary Judgment to Foster Wheeler in Asbestos Case

WILMINGTON, Del. – A Delaware federal court had denied a plaintiff motion to reconsider an order granting summary judgment to Foster Wheeler in an asbestos case, finding that the plaintiffs had “ample opportunity” to timely file the motion, but did not do so.

In the April 9 order, the U.S. District Court for the District of Delaware further found that the plaintiffs had not shown there was good cause to extend the time limitations on filing the motion to reconsider.
