Whittaker, Clark & Daniels Move to Dismiss Asbestos Talc Case on Jurisdiction, Pleading Grounds

FORT LAUDERDALE, Fla. –– Whittaker, Clark and Daniels has moved to dismiss an asbestos talc complaint, saying that the plaintiffs’ allegations fail to establish jurisdiction over the company or comply with the state’s procedural requirements for asbestos and silica cases.

In the Feb. 9 motion filed in the Florida 17th Judicial Circuit Court for Broward County, the defendant maintained that under the state’s Asbestos and Silica Compensation Fairness Act, the plaintiffs were required to assert the specific location of each alleged exposure, the relevant dates for each alleged exposure, and the location for each alleged exposure.
