9th Circuit Affirms Dismissal of Negligence, Strict Products Liability Claims in Asbestos Case; Allows Premises Liability Claims to Proceed

PASADENA, Calif. –– The 9th Circuit U.S. Court of Appeals has affirmed in part the dismissal of asbestos claims, opining that the lawsuit contained insufficient, non-conclusory allegations to state a plausible claim for relief or to put the defendant on notice of the basis of the claims against it.

In the Feb. 23 order, the 9th Circuit further stated that the complaint did not identify any specific product that defendant Northrop Grumman Systems Corp. itself manufactured, supplied, or was otherwise responsible for in a way that could give rise to the underlying claims.
