Last of Several Employers Responsible for Longshoreman's Mesothelioma, Court Holds

NEW ORLEANS - A federal appeals court has upheld a death benefit award against the last known employer of a longshoreman who died of mesothelioma, although could not be shown that his exposure to asbestos during the period he worked there was the cause of his fatal condition. New Orleans Stevedores, et al. v. Ibos, No. 01-60480 (5th Cir.).

In a decision issued Jan. 16, the Fifth Circuit U.S. Court of Appeals held that New Orleans Stevedores (NOS) was responsible for death and disability benefits to Peggy Ibos, whose husband died of mesothelioma several years after working for the company. …
