Ky. Appellate Court Reverses Summary Judgment Award in Asbestos Case Involving Radios

FRANKFORT, Ky. –– A Kentucky appellate court has reversed an award of summary judgment for two defendants in an asbestos exposure suit involving radios, saying that the plaintiffs had presented “at least” circumstantial evidence that created a genuine issue of material fact.

In the Sept. 10 opinion, the Kentucky Court of Appeals found that opposing evidence presented by defendants Zenith Electronics LLC and Motorola Solutions Inc. “should be evaluated by a jury not by a judge as part of summary judgment.”
