N.Y. Court Remands Asbestos Action, Says Plaintiffs Disclaimed Federal Causes of Action

NEW YORK –– A New York federal court has remanded an asbestos exposure suit, ruling that since the plaintiffs had specifically disclaimed federal causes of action, it no longer had jurisdiction over the matter.

In the Aug. 18 opinion, the U.S. District Court for the Southern District of New York also declined to exercise supplemental jurisdiction over the case, noting that only state-law claims and defenses remained after the plaintiffs had filed the amended complaint.

The plaintiffs asserted the claims on behalf of Thomas K. Maguire, contending that his exposure to asbestos-containing products caused him to develop lung cancer. The …
