Louisiana Court Remands Asbestos Action, Says Plaintiffs Disclaimed Causes of Action Relating to Service in U.S. Navy

NEW ORLEANS –– A Louisiana federal court has remanded an asbestos action, finding that the plaintiffs had specifically disclaimed any cause of action relating to the plaintiff’s service in the U.S. Navy.

In the Aug. 10 opinion, the U.S. District Court for the Eastern District of Louisiana agreed with the defendants that, should the plaintiffs end up pursuing such claims, that the federal court is the appropriate venue.

“However, the facts, as developed thus far, do not support removal at this time,” the court concluded.
