Missouri Appellate Court Reverses Decision Denying Class Certification in Asbestos Exposure Suit

KANSAS CITY, Mo. –– A Missouri appellate court has reversed a lower court’s decision denying class certification in an asbestos exposure suit, opining that the plaintiffs had in fact satisfied the requirements of bringing the medical monitoring action.

In the March 17 opinion, the Missouri Court of Appeals, Western District, found in part that the circuit court had erred when it failed to accept the allegations and evidence presented by the plaintiffs as true.
