SAN FRANCISCO –– Several parties have filed an amicus curiae brief in the California Supreme Court, urging the court to decline asbestos plaintiffs’ “invitation to create a broad new duty rule” in a dispute involving two take-home asbestos exposure cases.

The dispute pending in the California Supreme Court concerns conflicting decisions entered by intermediate appellate courts. In one case, the First District Court of Appeal issued a decision favoring the plaintiffs in the case against Pneumo Abex, while the Second District Court of Appeal found for BNSF Railway in the second case.
