Rhode Island Court Takes Judicial Notice of Tennessee Statutes for Asbestos Case

PROVIDENCE, R.I. –– A Rhode Island court has taken judicial notice of several Tennessee statutes the defendants argued should apply to a pending asbestos case.

In the March 5 order, the Rhode Island Superior Court took notice of Tennessee statutes dealing with the modified comparative fault doctrine and a cap on noneconomic damages.

The plaintiffs argued that Wayne F. Jones was exposed to asbestos-containing products in a number of locations. Specifically Jones alleged exposure for one year at Bethlehem Steel in Maryland, while the rest of the exposure allegedly occurred in Tennessee.
